Workers' Compensation

What You Need to Know

Being injured on the job is often a terrible experience. Sometimes the injury does not hurt as much as the treatment that you receive after the injury. The employer does not want a serious injury on the books. The insurance carrier wants to pay as little as possible for the claim. There are even cases of wrongful termination following an on-the-job injury.

After an Injury

If you have been injured at work in Colorado, you must notify your employer in writing within four business days. If your employer has appointed a physician for the treatment of work injuries, you should see that doctor to have the compensation of the workers to pay the bills. If you are having problems with the doctor your company has assigned to you, we can help you change doctors. Your employer must also notify the insurance company of the injury within 10 days. If your claim is denied, you have 45 days to file a request for a denial hearing. We can represent you at the hearing, or at any stage of the process.

The benefits

Injured workers are entitled to receive payment of their medical expenses and a portion of their wages, while not being able to return to work. Temporary disability benefits differ by partial temporary disability (TPD) and total temporary disability (TTD). Compensation of workers also pays different sums for three different types of permanent disabilities. If you are awarded permanent disability payments, we can help you receive a one-time payment instead of weekly benefits. Survivors of those killed at work are entitled to receive funeral expenses of $ 7,000, plus a death benefit.

Third Party Claims

Because our Denver Workers Signing Compensation Law provides legal services to injured individuals, our attorneys will analyze your case to determine if a third-party claim can be filed against someone other than your employer. Under the Colorado Workers' Compensation Act, employees cannot sue their employers. You can, however, pursue financial compensation from another person, for example, the driver of a car that hit while you were driving as part of your job. This is known as a "double dip" and you can handle both claims for yourself - the case of personal injury against the negligent driver as well as your workers compensation claim.
